Lawyer Profile

Attorney Shao Shiwei holds a Master of Laws degree from East China University of Political Science and Law and is one of the earlier lawyers in China to focus on criminal defense and criminal compliance in new economy sectors such as virtual assets, Web3 and AI.

Since joining Mankun, Attorney Shao Shiwei has continued to deepen her practice in virtual assets and Web3 criminal legal services, handling complex economic crime and cybercrime cases over the long term, including the crime of illegal business operations, fraud, the crime of running a casino, and the crime of misappropriation of occupational funds, and has gradually extended her professional practice to scenarios such as digital collectibles, GameFi and artificial intelligence.

Since beginning practice in 2018, Attorney Shao Shiwei has handled more than 300 criminal cases in total, of which more than 60 achieved effective defense outcomes such as case withdrawal by public security authorities, non-prosecution by procuratorial authorities, release on bail pending trial, suspended sentences imposed by courts, adjustment of charges or reduction of sentencing ranges.

Deconstructing Complex Cases Starting from Business Models

In her long-term frontline casework, Attorney Shao Shiwei has paid particular attention to the complex issues that arise when new technologies and new business models enter the traditional criminal law framework.

From virtual asset OTC and cross-border currency exchange, to crypto asset exchanges, Web3 projects and digital collectibles platforms, and further to the determination of criminal liability of project founders, management personnel, technical personnel and operations personnel, such cases often simultaneously involve multiple factors such as technical architecture, business models, fund flows, division of roles among personnel and subjective knowledge, making it difficult to reach an accurate judgment based solely on the analytical framework of traditional cases.

In response to the above characteristics, Attorney Shao Shiwei has gradually developed a defense methodology with distinct practical features:Focusing on reconstructing the facts of a case from dimensions such as business model, technical architecture, fund flows, subjective knowledge and specific role, and avoiding a broad determination of a client's criminal liability based solely on the amount involved, position or identity, or the results of fund flows.

For example, in cases involving illegal business operations with virtual assets and cross-border currency exchange, she focuses on distinguishing different conduct such as virtual asset trading, matchmaking and brokerage, fund settlement and foreign exchange trading, and examines the fund flows, transaction purposes and the client's actual degree of participation transaction by transaction; in cases involving crypto asset exchanges and the crime of running a casino, she insists on comprehensively reviewing facts and evidence according to the standard for a defense of innocence, and, based on the different roles of project organizers, business heads, technical personnel, operations personnel and ordinary participants, clarifies the boundaries of each person's responsibility and conducts refined defense.

Effective defense outcomes secured in multiple major and complex cases

Among the cases handled by Lawyer Shao Shiwei and her team, multiple matters involving amounts reachinghundreds of millions or even billions of yuanincludea virtual currency payment and settlement case involving 2.7 billion yuanvirtual currency payment and settlement cases,an OTC acceptance provider illegal business operation case involving 5 billion yuan, and an illegal business operation case involving the introduction of foreign exchange trading involving 600 million yuan. The aforementioned related cases respectively achieved effective defense outcomes such as suspended sentences and release on bail pending trial.

Among them, Lawyer Shao Shiwei's team once represented a cross-border virtual currency "matched-order" foreign exchange illegal business operation case in Shanghai involving more than 200 million yuan; the client represented was ultimately sentenced to a suspended sentence, and the relevant circumstances of the case were once reported by CCTV News.

Relying on professional experience accumulated over the long term, Lawyer Shao Shiwei has also been interviewed by media including Shanghai Television, Hong Kong's South China Morning Post, Economic Observer, Yicai, and Cover News, expressing professional views on topics such as criminal risks in virtual currency transactions, Web3 legal compliance, and cryptocurrency regulation.

Extending from criminal defense to enterprise risk prevention and control

Compared with merely handling criminal cases that have already occurred, Lawyer Shao Shiwei also continuously applies frontline case-handling experience to enterprise criminal risk prevention and control.

Through the review and study of a large number of real cases, she focuses on the criminal risks that Web3 projects may generate in areas such as business model design, technology development, operations and promotion, asset transactions and fund settlement, as well as the boundaries of responsibility among project founders, senior executives, technical leads and operations personnel, helping enterprises identify risks in advance, improve business processes and establish corresponding risk isolation mechanisms.

At present, Lawyer Shao Shiwei's professional practice has gradually extended from criminal defense to criminal compliance for Web3 enterprises, criminal risk assessment of business models, and personal criminal risk prevention and control for founders, senior executives and technical leads. She also continuously shares practical observations and case analyses in the new economy field through her personal WeChat official account "Lawyer Shao Shiwei." From resolving cases that have already occurred, to understanding industries and business models, and further to helping enterprises identify risks in advance, she is gradually building a criminal legal service system for the new economy field based on real case experience.

New Role, New Responsibility

Lawyer Shao Shiwei's promotion to partner this time will further strengthen Mankun's professional capabilities in the fields of virtual assets, Web3 criminal legal services and enterprise criminal risk prevention and control.

A new role means both recognition of past professional accumulation and a new responsibility and starting point. In the future, Lawyer Shao Shiwei will, in her new capacity as partner, continue to deepen her practice in criminal defense and criminal risk prevention and control in the virtual assets and Web3 fields, providing clients with more professional, pragmatic and truly implementable legal services.

Mankun will also continue to improve its talent development and partner development mechanisms, bringing together more outstanding legal talent, and continuously enhancing its professional service capabilities in a complex and rapidly changing industry environment.
