Cross-border finance and crypto paymentsBanks, channels and cooperation models

First, separate the three layers of brand, contract and funds

A white-label arrangement may be merely rebranded software, or it may include accounts, exchange, custody of funds and payment capabilities. In an assessment, it is not enough to look only at the supplier's demonstration page; the brand owner, the counterparty to the service contract, and the person controlling the bank or wallet account should each be confirmed separately. A scenario where the page uses your brand but the customer contract is signed by an upstream licensed institution and funds are paid directly to the upstream institution is a different structure from one where the customer contracts only with you and the upstream institution bears no obligations to customers at all.

Whether customers can understand it matters more than a single line in the footer

The actual service provider, its regulated status and the complaints channel should be clearly displayed before account opening, confirmation of a quote and payment. If the main page claims "we provide licensed accounts" while deep in the agreement it states "we only provide software", this can easily cause confusion about roles. The EU's MiCA prohibits entities without the relevant qualifications from using names or advertising that could easily lead people to mistake them for crypto-asset service providers; this also shows that brand presentation cannot be designed independently of the legal role.

The UK payment agent model is not a global white-label passport

Under FCA guidance, payment institution agents must meet registration requirements, and the principal institution must also effectively supervise them and bear corresponding responsibility for the agent's conduct. This cannot be established merely by writing "agent" into a contract between the parties, nor can payment agency be automatically extended to all crypto-asset activities. If the white-label provider separately controls customer stablecoins, arranges exchange or provides its own balance services, it is necessary to examine further whether that part exceeds the scope of lawful cooperation.

Set out exit and customer migration clearly before signing

What is most easily overlooked in white-label products is who handles customers after service suspension. It is advisable to agree on termination notice, transactions in progress, return of funds, complaint handling, export of customer data and the necessary account reopening procedures. Customer assets cannot be transferred away by the platform at will simply because the supplier changes, nor can data necessarily be transferred across institutions merely because the contract says "transferable". Conducting a service-suspension drill before launch is more likely to reveal gaps in responsibility than merely comparing interface prices.

Recommended actions

  1. Cross-check consistently the service entity shown on the account-opening page, the user agreement, the quote confirmation and the bill.
  2. Verify the agency or distribution arrangements and registration status, and do not treat a supplier's licence number as your own licence number.
  3. Clearly set out in the contract the responsibility for funds, orders in progress and customer data handling after service suspension.
