On October 19, 2026, the Ministry of Commerce and the General Administration of Customs issued Announcements No. 50, No. 51 and No. 52. The first two announcements adjusted the scope of dual-use items and the export methods, covering full-face tunnel boring machines, certain walking excavators, high-altitude wet shotcrete machines, and key components such as dredger mud pumps, dragheads and cutter heads; Announcement No. 52, effective from the date of issuance, re-established the customs questioning and identification procedures.

This set of rules affects more than equipment manufacturers. When Chinese enterprises undertake overseas metro, highway, mining, water conservancy and port projects, common structures include equipment sales, general engineering contracting, financing, long-term operation and maintenance, and spare parts supply. As long as one piece of equipment or one technology falls within the list, licensing, registration, customs declaration, payment and construction schedules may affect one another. Where contracts are still arranged as ordinary engineering equipment arrangements while delivery has already entered export control procedures, the most likely consequences are not abstract compliance assessments, but temporary hold-ups in cargo release, discrepancies in letter of credit documents, project delays and disputes over liability for breach of contract.

Shield tunneling machines are not subject to a single licensing regime

Announcement No. 50 controls all full-face tunnel boring machines, including earth pressure balance and slurry balance shield machines, as well as open-type, single-shield and double-shield rock tunnel boring machines. Specially designed cutter heads, screw conveyors, segment erectors, main drive systems and other key units, as well as related remanufacturing technologies, are also within scope.

Walking excavators adopt performance thresholds; where any one of the capabilities for crossing vertical obstacles, wading, crossing trenches or climbing slopes exceeds the indicators in the announcement, the item may fall within 2B904. High-altitude wet shotcrete machines are required to be used in areas above 3,000 meters in altitude and to simultaneously meet indicators for engines, motors, pumping, air compressors and low-temperature hydraulic oil, and related parts and technologies are also covered.

Of greater concern is the tiering by destination. Exports to "sensitive countries and regions with which China has disputes" shall be subject to license applications in accordance with the law, and no export may be made without a license; exports to other countries and regions may obtain export certificates through registration and information filing, but exporters and end users must undertake not to transfer or provide China-origin items to the aforementioned destinations without a license. Organizations and individuals outside China are also subject to corresponding re-transfer restrictions.

The announcements do not publicly list which countries and regions fall within that expression. Enterprises should not unilaterally treat a given destination as safe by default, still less rely solely on the geopolitical judgment of the sales department. The prudent approach is to verify the applicable path with the competent authorities at the quotation or bidding stage, and to reserve conditions in contracts for licensing, registration and changes in regulatory interpretation.

Dredger components and shield tunneling machines cannot use the same process

Announcement No. 51 adjusts specific dredger components, including mud pumps and pump casings and impellers meeting size and speed indicators, dragheads with suction pipe diameters of 0.55 meters, and cutter heads with cutter ring outer diameters of 2.1 meters. The announcement requires license applications for the export of the above items and does not adopt the expression in Announcement No. 50 that divides licensing and registration by destination.

This distinction directly affects a group's compliance matrix. The same overseas infrastructure project may simultaneously procure shield tunneling machines, general engineering machinery, dredging equipment and spare parts. If the system only routes by customer country, it is easy to miss the licensing requirements for key dredger components; if the system only screens by the name of the complete machine, it may miss pump casings, impellers and cutter heads sold, leased or replaced separately.

Reference customs commodity codes can only assist in locating items and do not replace the assessment of technical parameters. Announcements No. 50 and No. 51 simultaneously require that, for items that are controlled items, the remarks column of the customs declaration state "dual-use item" and list the export control code; for items that are not controlled but whose parameters, indicators or performance are close, the declaration shall also state "not a dual-use item" and fill in the specific parameters. Enterprises therefore need engineering and technical personnel, customs affairs personnel and legal personnel to jointly produce reviewable determination materials, rather than letting customs brokers make independent judgments based on commodity names.

Customs questioning will turn technical judgments into delivery timelines

Announcement No. 52 applies to a broader range of dual-use item exports. Where the export goods have not been submitted for inspection against the Ministry of Commerce license, and Customs has evidence that the goods may fall within the controlled scope, Customs shall issue a notice of inquiry. The consignor must, within 7 working days after receiving the notice, submit the customs declaration form, contract, invoice, transport documents, statement of circumstances and technical materials, each bearing the company seal; foreign-language materials must also be accompanied by a Chinese translation.

After Customs receives all the materials, it may make a determination on its own, or the General Administration of Customs may request the Ministry of Commerce to organize expert identification. In principle, Customs shall complete its determination or submit a request for identification within 15 working days after receiving all the materials, and the Ministry of Commerce shall issue an identification conclusion within 15 working days after receiving complete materials. However, time spent by the enterprise supplementing materials and time used for inspection and testing are not counted, and special circumstances such as major or difficult cases are not subject to this time limit.

During the inquiry and identification period, the relevant goods shall not be released. Unrelated other goods under the same customs declaration form may be split upon application and, after Customs assessment and consent, cleared separately. This means enterprises cannot treat the "two 15 working days" as the maximum dwell time, nor should they promise a definite arrival date without a technical file.

The Announcement turns technical proof into a matter of transport and payment collection management. The statement of circumstances must set out both performance indicators and main uses, and also explain the legal basis and factual reasons for considering the item not to fall within the controlled scope. If a product manual retains only marketing parameters, it cannot correspond to the thresholds in the control list; if drawings, test reports and contractual specifications contradict one another, the inquiry process will also be prolonged.

Transaction documents need to cover the flow of goods after the first export

Shield tunneling machines and large engineering equipment are often received by overseas project companies and subsequently transferred among different projects within the same group, or subleased or resold by contractors. Announcement No. 50 extends the restriction on re-transfer to specified destinations without a license to overseas organizations and individuals, and the country of the initial buyer does not end the end-use review.

Exporters may specify in the contract the end user, installation site, project name and permitted use, prohibit resale, subleasing, transfer, dismantling and the provision of remanufacturing technology without consent, and require the customer to notify before any change in the actual controller, end user, use or location. For distributor transactions, the buyer and project downstream of the distributor must also be identified, and "inventory sales" cannot be treated as the end use.

Contractual liability should also match the approval facts. A license or registration should preferably be made a precondition for shipment; if approval is delayed or the rules change, it should be clear how the delivery period is extended, who bears the costs, and when the contract may be terminated. The equipment price, transport fees, installation fees and technical service fees may be subject to separate payment milestones, so as to avoid all payments falling due at the same time because of a single regulatory procedure.

For projects using letters of credit, buyer's credit, export credit insurance or guarantees, the financial documents should also recognize regulatory delay. If a letter of credit accepts only a fixed shipment date, document discrepancies may arise before the license is obtained; if an advance payment guarantee does not exclude delays caused by the buyer's failure to provide end-user information, the equipment supplier may also face claims when it cannot lawfully ship.

General contractors and all parties in the supply chain cannot review only their own contracts

Overseas projects are often contracted by a general contractor, which then purchases from multiple equipment suppliers. Equipment suppliers hold the parameters, the general contractor holds the project, customer and route, the freight forwarder holds the transport arrangements, and the bank holds the financing conditions. Information is dispersed across different contracts, and any one party may be unable to complete the item and end-use assessment.

The general contractor should establish a project-level list mapping complete machines, key components, software, technical materials, maintenance and remanufacturing services to export control codes, customs commodity codes, parameter thresholds and supplier certifications. Equipment suppliers should be responsible for the authenticity of parameters and should agree to update them promptly when regulatory requirements change. Freight forwarders and customs brokers must not modify product names or parameters without authorization, and banks and insurers should obtain the contract version consistent with the license, registration and customs declaration.

After-sales services also require separate review. Replacing cutterheads, main drive systems, pump casings or impellers overseas, or providing remanufacturing, hydraulic control or pumping technology, may constitute a new export of items or technology. The fact that the original complete machine was lawfully exported does not automatically cover subsequent spare parts and remote technical support.

Preparations That Can Be Completed Before November 18

Enterprises can proceed on the basis of three tables. The first is the item determination table, recording model, version, technical parameters, control code, reference customs number, basis for determination and approver; for products close to the thresholds, attach test reports, drawings and parameter descriptions.

The second is the transaction flow table, setting out the contract buyer, payer, consignee, end user, installation site, project owner, carrier, transit port and possible subsequent reallocation. For transactions under Announcement No. 50, an undertaking not to transfer or provide the items should also be obtained, together with an ongoing notification obligation.

The third is the delivery evidence table, matching licence or registration documents, customs remarks, contract specifications, invoices, transport documents, end-user documents, test reports, delivery records and payment vouchers item by item. After receiving a customs query, an enterprise has only seven working days to prepare materials; technical and legal bases that are missing in ordinary times are very difficult to fill in at short notice.

Long-term contracts currently being performed must also be reviewed contract by contract. The new rules take effect on November 18, and the announcement does not provide a general exemption on the ground that a contract was signed earlier. Equipment not yet shipped, components delivered in batches and subsequent maintenance services should be assessed under the rules in force at the relevant time. Enterprises may complete classification and application preparations before the implementation date, but they cannot treat early shipment as a circumvention scheme.

Conclusion

This rule change links the technical parameters of large engineering equipment, project destinations, overseas flows and customs release. For Chinese equipment manufacturers and overseas engineering enterprises, what truly needs to be redone is the transaction process: identify items at the bidding stage, allocate regulatory risk at the contracting stage, verify licences or registrations before shipment, have financing documents acknowledge approval conditions, and continue to track end users and after-sales services after delivery. Only when the contract, goods, funds and evidence use the same set of facts can an enterprise preserve workable room between regulatory review and project performance.
